Terms of Use

These Terms govern your use of the mobile applications and website provided by MindNexus Labs LLC (“we”, “us”). By downloading or using our Apps you agree to these Terms. If you do not agree, do not use the Apps.

1. The Apps

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Apps on devices you own or control, for personal, non-commercial purposes. If you downloaded an App from the Apple App Store, your use is also subject to Apple's Licensed Application End User License Agreement; if these Terms conflict with it regarding the App, Apple's terms apply.

2. Not medical advice

MoodAnchor, ReJournal and any wellbeing content we publish are for self-tracking, reflection and general education only. They are not medical devices and do not provide diagnosis, treatment or emergency services. Always seek the advice of a qualified health professional with questions about a medical condition, and do not change any medication without medical advice. If you are in crisis, contact local emergency services immediately.

3. Your account

You are responsible for the security of your account and device. You must provide accurate information and be old enough to use the Apps under the laws of your country. You may delete your account at any time.

4. Your content

You own what you write and upload. You give us permission to store and process it only to operate the Apps for you. You must not upload unlawful content or content that infringes others' rights.

5. Purchases and subscriptions

Our Apps are free to download. Some features are available only with a paid auto-renewable subscription (for example, Kurdipeyv Premium removes ads). Prices and subscription periods are shown in the App before you buy and may vary by country.

  • Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
  • Subscriptions renew automatically at the same price and period unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • You can manage or cancel subscriptions in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
  • If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
  • Refunds are handled by Apple or Google under their own policies.

5a. Advertising

The free version of Kurdipeyv displays advertising provided by third-party ad networks. We are not responsible for the content of third-party ads or the websites they link to. MoodAnchor and ReJournal do not show ads.

6. Acceptable use

Do not misuse the Apps, including by attempting to access them in unauthorised ways, reverse-engineering them except where the law allows, or interfering with other users.

7. Intellectual property

The Apps, their design, text, images, word lists and audio are owned by MindNexus Labs LLC or its licensors and are protected by law. These Terms do not transfer any ownership to you.

8. Disclaimers

The Apps are provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not guarantee that the Apps will be uninterrupted or error-free, or that language content is free of mistakes.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to the Apps is limited to the amount you paid us in the 12 months before the claim, or USD 50, whichever is greater. Nothing in these Terms limits liability that cannot be limited by law.

10. Changes and termination

We may update the Apps or these Terms. We will post changes here and update the date above. We may suspend access if you seriously breach these Terms. You may stop using the Apps at any time.

11. Governing law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules, except where the law of your country of residence gives you mandatory protections.
